Legal, Social, Scientific and Mythic Perceptions of Breath Alcohol Testers

John Wisniewski of Winc Research has been an expert court witness for several court cases involving the software embedded in breath testers used in many states to provide evidence used to prosecute DUI offenders.

In addition to the safety and quality issues found in the software that are of concern to ISA members, issues regarding the legal views of these cases, and the common "urban myths" of software development that affect the adoption of standards used and recommended by the ISA, will be discussed.

Our speaker will discuss the technology behind common alcohol breathalyzers which information he has researched to provide technical consultation for two upcoming state supreme case hearings. He will share not only the technical aspects of qualifying breathalyzers, but also the legal, political, and common perception problems encountered in the cases, as well as the device manufacturer's dogged efforts to retain the status quo, and the factors of proprietary rights versus right-to-face-accuser guarantees in the Sixth Amendment.

About the speaker
John Wisniewski is the President of Winc Research, a corporation dedicated to developing new products and systems using software and firmware. Winc Research provides services that include product development, marketing, project management, reverse engineering, troubleshooting, and software design, development and testing.

John has worked on several military avionics and intelligence projects, the Voyager and Galileo planetary probes for the Jet Propulsion Laboratory, commercial airline avionics, voice recognition controlled products, multimedia programs, specialty products for medical care at home, and accessories for musical instruments for orchestral performance. Winc Research has recently developed a device to monitor laundry use and laundry reservation systems for commercial apartments and dorms, and has also developed a web-based monitoring system for that product, called LaundriMate, which is available in 30 states and in several Canadian provinces.
